Alfonso has over 22 years of experience in Commercial (Re/Insurance), Civil (Civil Liability), Administrative, and Constitutional matters. Mr. Loera has been recognized as one of the top e/Insurance attorneys by Legal 500 and Chambers Insurance Mexico (2021 and 2022). And clients recognize him as a flexible lawyer for cross–border Re/Insurance claims and coverage advice.

Alfonso is a specialized litigation lawyer with a broad background and experience in Re/Insurance-related matters. He has represented many Re/Insurance companies, brokers, and Lloyd’s syndicates in numerous contentious claims before federal and local Mexican courts; managing complex claims and long-tail accounts, and advising the Re/Insurance market on the best strategies for defending their interests in Mexico. His experience also encompasses designing and implementing preventive and out-of-court strategies to prepare litigation claims, and he is also well-versed in Alternative Dispute Resolutions (ADR) mechanisms.

He has a strong profile advising clients in defending their cases from claims brought by insureds and third parties against the Re/Insurance market in claims regarding damage/property, civil liability, professional liability (E&O), Directors, and Officers Liability (D&O), Public Officers Liability (P&O), administrative patrimonial liability, defective product, recall, and environmental liability; and has actively participated in subrogation and recovery proceedings.

Experience

Also, he has experience advising on claims regarding these matters in Mexico and/or around the world, providing coverage advisory on such claims in Re/Insurance cases, handling claims, or policies coverage applicability in different jurisdictions.

  • Advise the Re/Insurance market across eleven years (2009–2019) regarding civil and administrative liability claims brought by third parties affected against the Mexican State Electricity Company (CFE) and the Mexican Education Ministry (SEP).
  • Advise and manage an arbitration process in connection with the Mexican State Petroleum Company (Pemex) against an electric facility constructed by Pemex’s provider, that failed in the test phase, concluding in a satisfactory settlement for the involved parties.
  • Advise and manage the defense strategy of a judicial process against a Mexican Insurance Company (AIG), brought by one of the most important Mexican TV stations (TV Azteca), regarding a D&O coverage policy, concluding in a satisfactory settlement for all involved parties.
  • Advise and manage the defense strategy of an arbitration process against an international accountant iCloud program provider, regarding a supposed non-fulfillment of a SAAP contract essential obligations, concluding in a favorable arbitration award for Meta4.
  • Advise the reinsurance market in connection with an insurance liability judicial claim filed by one of the most important Cooper Mining Company in Mexico, regarding the request for coverage of expenses and losses caused by a leak of pollutant substances to the Rio Bacabuchi. The judicial process was concluded in a satisfactory settlement for the involved parties.
  • Advise the reinsurance market in connection with certain claims brought by third parties affected and/or their successors against Liquefied Petroleum Gas Distributors Companies, regarding several losses causing bodily injuries, deaths, and property damages, concluding in satisfactory settlements for the involved parties.
  • Design and implement an overall strategy to defend the interest of an insurance company (Seguros Banorte) against the judicial claim filed by the insured (a Mexican bank institution), regarding cybernetic frauds in all its ATMs; the judicial process concluded in a satisfactory settlement for the involved parties.
