Electronic Procurement Tracking Log
On October 1, 2021, published in the Official Federal Gazette, the Agreement setting forth the mandatory registration of contracts and operations of acquisitions, leases and services of the public sector in the Electronic Procurement Tracking Log and its Guidelines by the Ministry of Public Administration (Secretaría de la Función Pública).
The guidelines published set forth the general administrative provisions for the use of the Electronic Procurement Tracking Log (BESA).
The use of this system will be mandatory for the registration and follow-up of contracts and operations of acquisitions, leases and services of the public sector, with total or partial charge to federal resources, carried out by the entities of the Federal Public Administration in terms of the Law of Acquisitions, Leases and Services of the Public Sector (Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público).
It should be noted that procurement, lease and service contracts rendered from October 18, 2021 will be managed and audited through the log, and that the Public Procurement Audit Unit of the Ministry of Public Administration will be in charge of managing and operating BESA, i.e., the electronic system in which the control and follow-up of contracts and operations carried out by agencies, entities of the federal public administration and state and municipal public entities with federal resources will be carried out.
In addition to the above, the transitional provisions of the publication add that contracts effective as of October 18, 2021, and whose amount is over $15’000,000.00 MXP, excluding VAT, or its equivalent in foreign currency, must be registered in the BESA, until the interoperability of the information with the electronic system of governmental public information called CompraNet is ensured.
The agreement includes, among others, the technical requirements for the use of the system, the registration process and the faculties of its administrator, coordinators and operators.
