Dicho decreto entr\u00f3 en vigor el d\u00eda 2 de Mayo de 2019. Como antecedente, la &#8220;Reforma Laboral&#8221; tiene su origen y fundamento en tres fuentes:<\/p>\n<ul>\n<li>La Reforma constitucional en materia de administraci\u00f3n de justicia laboral que entr\u00f3 en vigor el 24 de febrero 2017.<\/li>\n<li>Los principios y directrices establecidos en el Capitulo 23 y Anexo A del Tratado Trilateral de Libre Comercio celebrado entre Estados Unidos de Am\u00e9rica y Canada (T-MEC).<\/li>\n<li>La ratificaci\u00f3n del Convenio 98 de la Organizaci\u00f3n Internacional del Trabajo (OIT) el 27 de septiembre de 2018 por el Senado de la Rep\u00fablica.<\/li>\n<\/ul>\n<p>En t\u00e9rminos generales, podemos dividir la &#8220;Reforma Laboral&#8221; en tres rubros (i) un nuevo sistema de justicia laboral; (ii) relaciones colectivas; (iii) relaciones individuales.<\/p>\n<p>Es importante resaltar que los art\u00edculos relativos al R\u00e9gimen de Subcontrataci\u00f3n (Outsourcing) no sufre por el momento modificaciones, sin embargo, podr\u00e1n ser revisadas en periodos legislativos posteriores.<\/p>\n\n\t\t<\/div> \n\t<\/div> \n\t<div class=\"wpb_text_column wpb_content_element \">\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><span style=\"text-decoration: underline;\">Nuevo Sistema de Justicia Laboral<\/span><\/p>\n<ul>\n<li>Se establece la desaparici\u00f3n (no inmediata) de las Juntas de Conciliaci\u00f3n y Arbitraje y en su lugar se crean Juzgados en materia de Derecho del Trabajo dependientes de los poderes Judiciales, Federales y Locales. Los Tribunales Federales y Locales. Los Tribunales Federales deber\u00e1n entrar en funciones en un plazo m\u00e1ximo de 4 a\u00f1os a partir de la entrada en vigor de la reforma y los Tribunales Locales un plazo m\u00e1ximo de 3 a\u00f1os.<\/li>\n<li>Creaci\u00f3n del Centro Federal de Conciliaci\u00f3n (CFC) y Registro Laboral (RL) y Centros de Conciliaci\u00f3n Locales: A nivel federal, tendr\u00e1 a su cargo la funci\u00f3n conciliadora y el registro de contratos colectivos de trabajo, reglamentos interiores de trabajo y de organizaciones sindicales y sus directivas. A nivel local desempe\u00f1ar\u00e1n la funci\u00f3n conciliadora;<\/li>\n<li>Los plazos relacionados con el CFC y EL son:\n<ul>\n<li>6 meses para la elaboraci\u00f3n y publicaci\u00f3n de su ley org\u00e1nica;<\/li>\n<li>2 a\u00f1os para iniciar el registro de Contratos Colectivos de Trabajo (CCT) y Organizaciones Sindicales;<\/li>\n<li>4 a\u00f1os para la funci\u00f3n conciliadora.<\/li>\n<\/ul>\n<\/li>\n<li>Los procedimientos que se encuentren en tr\u00e1mite ante la Secretar\u00eda de Trabajo y Previsi\u00f3n Social, seg\u00fan corresponda, continuar\u00e1n conociendo de los procedimientos individuales, colectivos y registrales que se inicien con posterioridad a la entrada en vigor del presente Decreto, hasta en tanto entren en funciones los Tribunales federales y locales y los Centros de Coalici\u00f3n, conforme los plazos previstos.<\/li>\n<\/ul>\n\n\t\t<\/div> \n\t<\/div> \n\t<div class=\"wpb_text_column wpb_content_element \">\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><span style=\"text-decoration: underline;\">Relaciones Colectivas<\/span><\/p>\n<ul>\n<li>Cualquier notificaci\u00f3n de emplazamiento a huelga que tenga por objeto la celebraci\u00f3n de un CCT, revisi\u00f3n integral o salaria del mismo, deber\u00e1 presentarse acompa\u00f1ada de la &#8220;Constancia de Representatividad&#8221;; de lo contrario dicho aviso de huelga no proceder\u00e1. Esta medida pretende terminar con la pr\u00e1ctica de emplazamientos a huelga por sindicatos que no cuentan con el apoyo ni la representaci\u00f3n de los trabajadores del centro de trabajo. As\u00ed tambi\u00e9n, para la elaboraci\u00f3n, dep\u00f3sito y registro de un CCT se requerir\u00e1 de la obtenci\u00f3n de una &#8220;Constancia de Representatividad&#8221; por medio de la cual el Sindicato acreditar\u00e1 el % de trabajadores que manifestaron su adhesi\u00f3n.<\/li>\n<li>La nueva Ley reconoce que los miembros de los sindicatos tendr\u00e1n los derechos de libertad de asociaci\u00f3n y participaci\u00f3n en organizaciones laborales; entre los m\u00e1s importantes destacan que el trabajador podr\u00e1 decidir y elegir:\n<ul>\n<li>Pertenecer o no a un sindicato sin represalias.<\/li>\n<li>Ser electo como miembro de la directiva de una organizaci\u00f3n sindical a trav\u00e9s del voto personal, libre y secreto.<\/li>\n<\/ul>\n<\/li>\n<li>En un plazo m\u00e1ximo de 4 a\u00f1os siguientes a la entrada en vigor de la presente reforma, todos los contratos colectivos de trabajo existentes deber\u00e1n revisarse conforme al procedimiento establecido para el efecto.<\/li>\n<\/ul>\n\n\t\t<\/div> \n\t<\/div> \n\t<div class=\"wpb_text_column wpb_content_element \">\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><span style=\"text-decoration: underline;\">Relaciones Individuales<\/span><\/p>\n<ul>\n<li>Se deber\u00e1 tener cuidado en los Contratos de Presentaci\u00f3n de Servicios que se tengan celebrado, en virtud de que no producir\u00e1 efecto legal las estipulaciones que busquen encubrir una relaci\u00f3n laboral con actos simulados para evitar el cumplimiento de obligaciones laborales y\/o de seguridad social;<\/li>\n<li>El Contrato Individual de Trabajo deber\u00e1 contener la designaci\u00f3n de beneficiarios en caso de muerte o desaparici\u00f3n derivada de un acto delincuencial.<\/li>\n<li>Las terminaciones laborales ser\u00e1n ratificadas ante los Centros de Conciliaci\u00f3n o Tribunal Laboral que corresponda.
