Erick is Associate attorney with over 10 years of experience in labor matters, specializing in legal counsel and representation of national and foreign companies. His practice focuses on consulting, litigation, and labor compliance, as well as the strategy in hiring, termination of employees and executives (with cause and without cause), labor audits, and defense in labor lawsuits, providing practical solutions that strengthen compliance with labor legislation and foster solid labor relations within companies.
He advises businesses at various stages of their operations in Mexico, from establishment to closure, including the continuous training of human resources personnel on labor matters. Has participated in internal audits to ensure that companies comply with current labor regulations and has collaborated in the drafting, review, and modification of individual and collective employment contracts, internal work regulations, codes of conduct, the implementation of labor policies, and ensuring their compliance.
Erick provides guidance on fulfilling obligations such as profit-sharing, overtime pay, and other employee benefits, as well as preventing legal contingencies. He has been involved in processes related to mergers, acquisitions, corporate restructuring, and subcontracting.
He develops strategies for individual and collective labor litigation, responds to strike notices, handles labor inspections, and resolves conflicts derived of labor terminations with cause, employer substitutions, and employee transfers. Additionally, he has experience in preparing amparo lawsuits, nulity lawsuits, and appeals before the IMSS to challenge labor risk classifications.
Representative Matters
Participation in an internal investigation process at a pharmaceutical company located in Mexico City, where the breach of some internal policies by a group of employees, including the CEO, was detected. Sufficient evidence was obtained during the investigation, which led to the termination of the employment relationships with cause with the involved employees.
