Law to Promote Public Trust.

LAW TO PROMOTE PUBLIC TRUST (LEY DE FOMENTO A LA CONFIANZA CIUDADANA)

On January 20, 2020, the Law to Promote Public Trust (Ley de Fomento a la Confianza Ciudadana) was published in the Federal Official Gazette (Diario Oficial de la Federación). This Law seeks to generate an environment of trust for the voluntary compliance of regulatory and tax obligations and to slim down the bureaucratic apparatus. This law will enter into force on January 21, 2020; however, the benefits that it will grant have not been determined.
Under the Law, a database known as the Padrón Único de Fomento a la Confianza Ciudadana is created. Both individuals and companies may register in this Padron free of charge and it will be understood as an act of good faith since, when registering, they shall state that they are in compliance with their regulatory and tax obligations and that they undertake to continue to comply with them. Derived from the registration in the Padron, the registered persons will receive certain benefits and administrative facilities agreed by the Ministry of Economy (Secretaría de Economía) through the National Commission of Regulatory Improvement (Comisión Nacional de Mejora Regulatoria) and those mentioned on programs of the Federal Public Administration or agreements.
To determine the effective compliance of the obligations of the persons registered in the Padron, the Commission will be entitled to make a strategic selection for the analysis of the information registered.
Persons who incur in bad commercial practices or irregular operation will be suspended from the Padron and may not be subject to the benefits and administrative facilities linked to it for a period of one year. In case of recidivism, the removal from the Padron will be extended to a period of five years. In the event that a person on the Padron is subject to home visits or to inspection or verification procedures, registration on the Padron will be preventively suspended.
It should be noted that the provisions of the Law will not be applicable in the case of tax, customs, labor, social security, foreign trade and transactions involving funds illegally obtained.
